Kelin Algayer’s decision to transition her legal career from Brazil to Canada was driven by a desire to practice law internationally. During her time in law school, Kelin knew she wanted to pursue a legal career abroad, recognizing the challenge of adapting to a different legal system. After exploring various options, Canada became particularly appealing to her due to the opportunity to not only learn a new legal system but also get licensed and continue building her career. She saw an LLM in common law in Canada as the ideal route to achieve this goal.

Comparing Legal Practice in Brazil and Canada

Kelin notes several similarities between practicing law in Brazil and Canada. She highlights Canadian legal culture as a key difference, particularly the strong sense of collegiality and a shared commitment to doing the right thing. This culture, she explains, makes the legal environment both competitive and motivating, with lawyers constantly striving to develop their skills and deliver exceptional service.

Influence of Brazilian Legal Background

Kelin’s experience in environmental and public law in Brazil has significantly influenced her practice in Canada. Upon transitioning, she found that municipal law in Canada had many parallels with her previous work in Brazil. This background helped her secure a position in an area that aligned with her experience and opened doors in a Bay Street law firm. Her litigation skills, developed in Brazil, also played an important role during her interviews, where these abilities were highly valued.

Adapting to a New Legal Landscape

Despite the challenges of transitioning to a new legal system, Kelin remains optimistic about the opportunities available for Brazilian lawyers in Canada. She advises those looking to establish their careers from the ground up, such as through summer programs and articling, to be patient and open to adapting to a new culture and developing new skills. “Not everyone will value your Brazilian experience right away,” she says, but adds that as one gains experience, this recognition will come. Kelin emphasizes the importance of connecting with the Brazilian legal network in Canada, which has been invaluable in her journey.

Specializing in Municipal Law and Land Use Planning

Kelin’s practice in Canada focuses on municipal law and land use planning. Her role involves helping clients with development applications and appeals, providing legal opinions on planning policies, and handling court applications and provincial offences proceedings.

Overcoming Language and Cultural Barriers

Like many internationally trained lawyers, Kelin initially faced challenges with language and cultural differences when practicing law in Canada. She found it takes time to feel comfortable going to court, speaking to clients confidently, and connecting with potential employers. Patience and resilience, she notes, are key to overcoming these obstacles and continuing to pursue her professional goals in Canada.

The Role of Brazilian Lawyers in Canada

Kelin believes Brazilian lawyers bring a unique perspective to the Canadian legal landscape, adding value through their diverse experiences and backgrounds. She highlights the importance of demonstrating openness to learning and adapting to Canadian culture while also showcasing the value Brazilian lawyers can bring to legal practices. Kelin stays connected to the Brazilian legal community in Canada through her involvement with the Brazil Canada Bar Association (BCBA) and regular interactions with other Brazilian lawyers. She values these connections for exchanging ideas and insights and offers her support to those just starting their legal careers in Canada through coffee chats and advice on navigating the licensing process.

Support Networks and Resources

Throughout her journey, she found tremendous support from other Brazilian lawyers who had already navigated the licensing process in Canada. The Brazilian community provided valuable advice and insights, helping her carve out her own path in the Canadian legal system.

Looking Ahead

Kelin’s career aspirations include continuing her growth in private practice, particularly in municipal law. She remains excited about the opportunities to learn from her colleagues and partners, despite her prior experience in Brazil, and looks forward to further developing her skills in Canada.
